1. About buildmymenu.app

buildmymenu.app is operated by Sean Molloy (the "Seller", "we", "us"), a business established in Ireland. By using our service you ("you", "Customer") agree to these terms. If you do not agree, do not use the service.

2. Authority

If you are using buildmymenu.app on behalf of a business, you confirm you have authority to bind that business. Otherwise you confirm you are of legal age to enter into a contract.

3. The service

buildmymenu.app lets restaurants, cafés, food trucks and hospitality businesses create digital menus, generate QR codes, import existing PDF menus, translate menus, and view analytics. Features depend on your subscription plan.

4. Acceptable use

You must not:

  • Use the service unlawfully or in violation of any applicable law;
  • Upload fraudulent, misleading, defamatory or infringing content;
  • Use the service to send spam or unsolicited messages;
  • Interfere with the security or integrity of the service (no malware, probing, scraping, reverse engineering);
  • Resell, redistribute or sublicense the service without our written consent;
  • Circumvent technical limits, tier restrictions, or quotas.

5. Account & credentials

You are responsible for keeping your login credentials confidential and for all activity under your account. You must provide accurate information and keep it up to date.

6. Intellectual property

buildmymenu.app and its software, branding and documentation are our intellectual property. We grant you a limited, non-exclusive, non-transferable right to use the service within your selected plan. Your menu content, logos and images remain yours — you grant us a limited licence to host and process them solely to provide the service.

7. Payment and subscription

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. For payment, billing, taxes, cancellations and refund mechanics, see Paddle's Buyer Terms.

Subscriptions renew automatically at the end of each billing period until cancelled. You can cancel anytime; you keep access until the end of your current billing period. Upgrades and downgrades take effect immediately with prorated billing.

8. Service level

We work to keep buildmymenu.app available but do not guarantee uninterrupted or error-free performance. We may carry out maintenance with reasonable notice.

9. Warranties

To the fullest extent permitted by law we disclaim all implied warranties of merchantability, fitness for a particular purpose and non-infringement.

10. Liability

Our aggregate liability is capped at the fees you paid in the 12 months preceding the claim. We are not liable for indirect, consequential or special damages (loss of profits, data, goodwill). Nothing limits liability that cannot be excluded by law.

11. Indemnity

You indemnify us for claims arising from your content, your unlawful use of the service, or your breach of these terms.

12. Suspension and termination

We may suspend or terminate your access for material breach, non-payment, security or fraud risk, or repeated/serious policy violations. On termination you have 30 days to export your data, after which it may be deleted.

13. Governing law

These terms are governed by the laws of Ireland. Disputes are subject to the exclusive jurisdiction of the courts of Ireland. Nothing in these terms affects your mandatory rights as a consumer under Irish or EU law, including, where applicable, your right of withdrawal under EU consumer protection rules.

14. Assignment

You may not assign these terms without our consent. We may assign them as part of a merger, acquisition or sale of assets.

15. Force majeure

Neither party is liable for failure to perform due to events beyond reasonable control (acts of God, war, internet outages, government action).
